The following are some examples of verdicts and settlements obtained by Oren & Paboojian on behalf of their clients: Stacy Johnson-Klein vs. CSUF (Sexual Discrimination) Nearly three years in the making, the Johnson-Klein case surely ranks as one of the most compelling civil actions in San Joaquin Valley legal history.
Result: $19,074,673.00 verdict Jane Doe and John Doe vs. concrete pumping truck company (wrongful death/personal injury) Plaintiffs ages 26 and 27 were traveling in a vehicle with their two young daughters, ages 2 and 7. While stopped, a concrete pumping truck owned by the defendants rearended the back of plaintiff’s vehicle. As a result, plaintiffs daughters were killed in the accident.
Result: $7,500,000.00 settlement Auto vs. Truck (Wrongful Death) Plaintiff, age 42 at the time of the accident, was involved in an automobile accident which involved her vehicle and a truck. Plaintiff’s 15-year old daughter was a passenger in the vehicle and was killed when their vehicle ran into the rear of a tractor trailer that had slowed down for a dead dog in the road. Plaintiff filed a lawsuit against Defendants for wrongful death which resulted in the largest wrongful death award in Madera County Superior Court history.
Result: $2,417,701.00 verdict Jane Doe vs. Car Manufacturer (Products Liability; Personal Injury) Plaintiff, age 30, was traveling in her vehicle that overturned causing severe injuries to Plaintiff. As a result of, Oren & Paboojian filed a lawsuit against the car manufacturer.
Result: $2,400,000.00 settlement Pedestrian vs. Truck (Wrongful Death) On August 26, 2004, Plaintiffs’ decedent child, age 9, was riding his bicycle to school when Defendant’s driver, driving a 64 foot tractor trailer struck the minor child and backed over him. As a result of this accident, Plaintiffs filed a wrongful death action against Defendants.
Result: $2,065,000.00 settlement Employment/Fraud Case Plaintiff, a 43 year old parts manager, was wrongfully terminated by Defendant. He subsequently sued the car dealership where he worked for alleged fraud, intentional infliction of emotional distress and negligent misrepresentation. As a result of his termination, Plaintiff suffered wage loss and emotional distress. Plaintiff was awarded punitive damages at the time of trial.
Result: $1,950,913.00 verdict Dangerous Condition - Premise Liability (Wrongful Death) Plaintiff, mother of two children, filed a wrongful death lawsuit against Defendant Cemetery District. Plaintiff’s two daughters were buried alive in a pile of dirt. The children fell into a 30 foot pit dug out by Defendants. The pit was directly across the street from an elementary school.
Result: $1,850,000.00 settlement Premise Liability/Electrocution Case (Wrongful Death) On June 30, 2005, Defendant drove his tractor trailer to Plaintiff’s home. Plaintiff’s husband, a 29-year old horseshoer was electrocuted and killed when Defendant parked his tractor trailer under a power line. Plaintiff sued for negligence and wrongful death.
Result: $1,700,000.00 settlement Auto vs. Bulldozer (Personal Injury) In May of 2004, Plaintiff, age 16 and a high school student, was driving her vehicle southbound when she came upon a construction site. The site was operated by Defendant Construction Company. At that time, a large earthmoving truck crossed over the roadway striking Plaintiff and severely injuring her.
Result: $1,612,000.00 settlement High School Abuse Case Plaintiff, Jane Doe, age 16 at the time of the incident, was a high school student and began to have a romantic relationship with a 26-year old female employed by the School District as an instructional aide and who was also the women’s assistant basketball coach. Plaintiff, through her Guardian ad Litem, filed an action against the School District for negligence. As a result of Defendant’s negligence, Plaintiff suffered severe psychological and psychiatric damage. Plaintiff successfully tried her case against Defendant and obtained one of the largest verdicts in Kings County history.
Result: $1,548,000.00 verdict Jane Doe vs. Doctor (Medical Malpractice; San Diego, CA) Plaintiff and her husband filed a medical malpractice action against a San Diego doctor for failing to diagnose a lump found in Plaintiff’s left breast that was cancerous. As a result, Plaintiff and her husband sued the doctor for medical malpractice. Plaintiffs successfully litigated their case in San Diego County.
Result: $1,514,000.00 verdict Apartment Mold Case Approximately 24 families brought a fraud claim, negligent infliction of emotional distress claim, and breach of implied warranty of habitability against Defendants. Plaintiffs’ claimed that Defendants failed to inform Plaintiffs that a number of apartments were mold infested. As a result of the mold, Plaintiffs suffered a wide range of injuries including asthma, respiratory problems, headaches, and flu like symptoms.
Result: $1,440,000.00 settlement Jane Doe and John Doe vs. Helmet Manufacturer/Distributor/Retailer (Wrongful Death/Products Liability) 55 year old motorcyclist fell off his motorcycle at approximately 20 miles per hour when his Boneyard helmet came off his head prematurely. As a result, decedent’s head struck the ground, which resulted in a severe fracture that ultimately caused his death. Decedent’s two adult children sued the helmet manufacturer, distributor and retailer for a defect in design and maufacturing of the motorcycle helmet.
Result: jury verdict: $800,000.00 reduced down to $650,000.00; settlement with some defendants for $1.235 million Employment Case (ADA) Plaintiff, 49-year old Police Officer, was injured in the course of his employment as a Police Officer for the City of Visalia. He was involuntarily forced to retire from his job by the City of Visalia claiming he was not able to perform his job duties as a Police Officer. A lawsuit was filed for Disability Discrimination/Wrongful Termination.
Result: $1,002,000.00 verdict Accounting Malpractice (CPA Firm) Plaintiff sued his accountants for accounting malpractice, fraud, misrepresentation, negligence. In addition, Plaintiff sued the CPA firm for trust mishandling.
Result: $1,000,000.00 settlement Auto Accident (Personal Injury) Plaintiff, a 17-year old high school student, was rear ended at approximately 40 miles per hour, suffering severe injuries to his neck and back. Plaintiff’s injuries resulted in a discectomy to his cervical spine.
Result: $875,000.00 settlement Defamation Action Plaintiff, a 52 year-old car general sales manager for a local car dealership, was defamed when Defendants prepared "wanted" posters defaming employees who had left for a rival dealership. these posters were considered defamatory and injured and humiliated Plaintiff when they were forwarded to the rival dealership.
Result: $775,000.00 binding arbitration award Employment Action Plaintiff, a 40-year old sales representative, was terminated as a result of her complaints of sexual harassment. Plaintiff filed a lawsuit for wrongful termination, retaliation, and sex harassment.
Result: $679,000.00 verdict Pedestrian vs. Forklift Accident 42-year old lady lost her husband after being married 12 days after he walked between a truck that was backing up and a forklift while at his place of employment.
Result: $506,000.00 settlement Premise Liability 36-year old lady was exposed to dust from sandblasting operations at a work site at the Fresno Airport. Plaintiff inhaled the dust caused by the employees of business sandblasting at a time when people would be entering the airport and without proper warnings to the public. Plaintiff suffered burns to her eyes and lungs and developed reactive airways dysfunction syndrome with symptoms like severe asthma.
Result: $485,000.00 settlement Civil Rights Case (Strip Search) Plaintiff and her daughter were arrested for a minor offense and later strip searched at the Defendant jail facility. Plaintiff’s sued for intentional infliction of emotional distress for violation of their civil rights.
Result: $300,000.00 settlement Auto Accident (Personal Injury; Oakland, California) This accident involved a low speed impact whereby Plaintiff was rear ended at less than 10 miles per hour by Defendant. As a result of the low rear end impact, Plaintiff sustained severe injury to her neck and back.
Result: $200,000.00 verdict Dog Bite Incident (Personal Injury) Plaintiff, a 21 year old female while at a gathering with friends at a home of one of the individuals was attacked by a pit bull which resulted in severe injuries and permanent scarring to Plaintiff.
Result: $200,000.00 settlement Employment Action (Sexual Harassment) Female bartender was sexually harassed by bar owner.
Result: $90,000.00 settlement Personal Injury (Pharmacy) Prescription misfilled by pharmacy causes hospitalization of 16 year old young man.
